1. About Five Castles

Jesus in Five ("the App") is operated by Five Castles LLC, a Wyoming limited liability company ("Five Castles", "we", "us"). By creating an account or using the App, you ("you", "user") agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

2. Eligibility

You must be at least 16 years old to create an account. If you are between 16 and 18 (or the age of majority in your jurisdiction), you confirm that a parent or guardian has reviewed and consented to these Terms on your behalf. The App is not intended for users under 16.

3. Account

You are responsible for maintaining the confidentiality of your account credentials and your Recovery Code. Activities undertaken with your account are your responsibility. You agree to:

  • Provide accurate and current information when registering
  • Keep your password and Recovery Code secure
  • Notify us immediately at support@jesusinfive.com if you suspect unauthorized account access
  • Not share your account with others

Without your Recovery Code, your encrypted journal content cannot be restored from a new device — even by us. See our Privacy Policy, Section 4, for details on client-side encryption.

4. Subscription Terms

The App is offered as a subscription service ("River Membership") through the Apple App Store. Subscription pricing, billing periods (monthly, annual), and trial offers (if any) are displayed within the App before you confirm purchase.

5. Auto-Renewal and Cancellation

The River Membership automatically renews at the end of each billing period unless cancelled at least 24 hours before the period ends. The renewal charge applies to the same Apple ID used at signup.

To cancel: open the Settings app on your device → tap your Apple ID at the top → tap Subscriptions → tap Jesus in Five → tap Cancel Subscription. Cancellation takes effect at the end of the current billing period; you retain access until that date. We cannot cancel your subscription on your behalf — all subscription management is controlled by Apple.

Federal disclosures (ROSCA – Restore Online Shoppers' Confidence Act, 15 U.S.C. §§ 8401–8405): We provide clear notice of the auto-renewal feature, the recurring charge amount, the billing frequency, and the cancellation procedure before you complete the purchase. By tapping the purchase confirmation in Apple's checkout, you provide your express informed consent to the recurring charges.

California residents (Automatic Renewal Law, Cal. Bus. & Prof. Code § 17600 et seq.): The auto-renewal terms above are disclosed conspicuously before purchase. You may cancel at any time via the Apple subscription management settings described above. To exercise additional rights specific to California ARL, contact support@jesusinfive.com.

FTC Click-to-Cancel Rule (16 CFR Part 425): Cancellation is available through the same channel as enrollment (the Apple App Store) without additional friction or retention offers required to complete cancellation.

EU/EEA/UK residents: Under EU Directive 2011/83/EU on Consumer Rights (Article 16(m)), the right of withdrawal does NOT apply to digital content (such as App subscriptions) once supply has begun with your prior express consent. By starting your subscription you acknowledge this exception and waive the 14-day right of withdrawal. You may still cancel future auto-renewals at any time without penalty via the cancellation procedure above.

Refunds: Refund requests are handled exclusively by Apple through your purchase history (reportaproblem.apple.com). Five Castles cannot issue refunds for App Store purchases.

6. AI Content Transparency

The App generates certain content using artificial intelligence (Anthropic Claude), specifically the "Reflection Sub-Cards" and "Burden Advice" features. This AI-generated content:

  • Is clearly labeled as "AI-generated" in the user interface, in accordance with California Business and Professions Code §17940 and the EU Artificial Intelligence Act, Article 50 (transparency obligations for limited-risk AI systems).
  • Is intended as a complement to your personal reflection, not as a replacement for human pastoral, psychological, or medical guidance.
  • May contain inaccuracies, theological imprecisions, or unintended interpretations. Use of AI content is at your discretion.
  • Should not be considered authoritative spiritual direction nor a substitute for engagement with Scripture, your local Christian community, or qualified spiritual mentors.

You retain ownership of your reflections (the input you provide). The AI-generated responses are provided to you for personal use; you may not republish them as your own original content.

7. Acceptable Use

You agree NOT to:

  • Use the App for any illegal, harmful, or harassing purpose
  • Attempt to reverse-engineer, decompile, or extract the App's source code
  • Bypass authentication, encryption, or licensing controls
  • Use the App to generate or distribute content that is hateful, defamatory, or otherwise offensive
  • Submit prompts designed to manipulate or jailbreak the AI features
  • Resell, sublicense, or commercially exploit the App without our written consent
  • Use automated tools (bots, scrapers) to interact with the App

Violation may result in termination of your account without refund.

8. Health and Safety Disclaimer

The App is a spiritual reflection tool. It is NOT a medical device, NOT a mental health treatment, and NOT a substitute for professional psychological or psychiatric care.

The AI-generated content (especially Burden Advice) is intended for spiritual encouragement only. If you are experiencing severe distress, thoughts of self-harm, suicidal ideation, abuse, or any psychiatric or medical crisis, please:

  • United States: Call or text 988 (Suicide and Crisis Lifeline) immediately.
  • Other countries: Contact your local emergency services or a qualified mental health professional.

Do not delay seeking professional help in favor of using the App.

9. Intellectual Property and Trademarks

Our content: The App's structure, prompts, devotional methodology (the "Five Pillars: Living Word, Sign of Grace, Burden Handed Over, Kingdom Seed, The Trace"), interface design, illustrations, and brand assets are owned by Five Castles LLC and are protected by copyright and trademark law. JESUS IN FIVE™ is a trademark of Five Castles LLC, application Serial #99767730 filed with the United States Patent and Trademark Office in International Classes 9 and 16 on April 16, 2026.

Your content: You retain all rights to the reflections, notes, and personal entries you create within the App ("Your Content"). By using the App, you grant Five Castles a limited, worldwide, royalty-free license to process Your Content solely for the purpose of providing the service to you (storage, synchronization across your devices, AI feature input). We do not claim ownership of Your Content and do not use it to train any AI models, marketing material, or third-party products.

Scripture: Scripture quotations used in the App are from translations licensed or used under fair use as detailed in the Copyright Info page within the App.

10. Accessibility

Five Castles is committed to making the App accessible to users with disabilities. The App targets compliance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA where technically feasible on mobile platforms. We support iOS accessibility features including VoiceOver screen reader, Dynamic Type for adjustable text size, and Reduce Motion preferences.

If you encounter accessibility barriers, please contact accessibility@jesusinfive.com and we will work to address them in a timely manner.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OPERATION. FIVE CASTLES DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU IN FULL. WHERE WARRANTIES CANNOT BE EXCLUDED, THEY ARE LIMITED TO THE SHORTEST PERIOD AND NARROWEST SCOPE PERMITTED BY APPLICABLE LAW.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FIVE CASTLES, ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF DATA, LOSS OF PROFITS, EMOTIONAL DISTRESS, OR INTERRUPTION OF SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY AND ALL CLAIMS RELATING TO THE APP SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID FOR SUBSCRIPTION ACCESS IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS ($100.00).

NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FOR FRAUD, OR FOR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED BY APPLICABLE LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless Five Castles LLC, its officers, members, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

  • Your violation of these Terms;
  • Your misuse of the App, including any violation of acceptable use restrictions (Section 7);
  • Your infringement of any third-party rights, including intellectual property or privacy rights, through your use of the App;
  • Content you submit to the App that violates the rights of any third party or applicable law.

14. Termination

You may terminate your account at any time via Settings > Delete My Account. Termination is permanent and irreversible; your data will be purged per the retention schedule described in our Privacy Policy.

We may suspend or terminate your account if you violate these Terms, attempt fraudulent or abusive behavior, or if required by law. We will provide reasonable advance notice where feasible.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.

The foregoing does not deprive consumers of mandatory protections of the law of their place of residence where such protections may not be derogated from by contract (e.g., EU consumer protections, mandatory provisions of UK or Spanish consumer law).

16. Apple App Store Terms (EULA Schedule 1 Acknowledgment)

This section applies because the App is distributed through the Apple App Store and supplements Apple's standard Licensed Application End User License Agreement ("Apple EULA"):

  • Parties: These Terms are an agreement solely between you and Five Castles LLC, not with Apple, Inc. Apple is not responsible for the App or its content.
  • License scope: The license granted to you is limited to a non-transferable license to use the App on any Apple-branded products that you own or control and as permitted by the Usage Rules in the Apple App Store Terms of Service.
  • Maintenance and support: Five Castles is solely responsible for providing maintenance and support services for the App. Apple has no obligation to furnish any maintenance or support.
  • Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Product claims: Five Castles, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App, including but not limited to product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • Intellectual property: In the event of a third-party claim that the App or your use of the App infringes that third party's intellectual property rights, Five Castles will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal compliance: You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Third-party beneficiary: You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

17. General Provisions

Entire agreement: These Terms, together with the Privacy Policy and any in-App notices, constitute the entire agreement between you and Five Castles regarding the App and supersede any prior agreements on the same subject.

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment: You may not assign these Terms; we may assign them to a successor entity (e.g., in a corporate restructuring or acquisition).

Force majeure: We are not liable for failures caused by events beyond our reasonable control (natural disasters, war, government action, infrastructure outages).

Amendments: We may update these Terms. Material changes will be communicated through the App or by email at least 30 days before they take effect. Continued use of the App after the effective date constitutes acceptance.

4. Términos de la suscripción

5. Renovación automática y cancelación

7. Uso aceptable

Te comprometes a NO:

  • Usar la App con fines ilegales, dañinos o de acoso

  • Eludir los controles de autenticación, cifrado o licencias
  • Usar la App para generar o distribuir contenido odioso, difamatorio o de otra forma ofensivo

  • Revender, sublicenciar o explotar comercialmente la App sin nuestro consentimiento por escrito
  • Usar herramientas automatizadas (bots, scrapers) para interactuar con la App

8. Aviso de salud y seguridad

La App es una herramienta de reflexión espiritual. NO es un dispositivo médico, NO es un tratamiento de salud mental, y NO es un sustituto del cuidado psicológico o psiquiátrico profesional.

El contenido generado por IA (especialmente Consejo de Carga) está diseñado únicamente para aliento espiritual. Si estás experimentando angustia severa, pensamientos de autolesión, ideación suicida, abuso, o cualquier crisis psiquiátrica o médica, por favor:

  • Estados Unidos: Llama o envía un mensaje al 988 (Línea de Suicidio y Crisis) inmediatamente.

10. Accesibilidad

Puedes terminar tu cuenta en cualquier momento vía Ajustes > Eliminar Mi Cuenta. La terminación es permanente e irreversible; tus datos se purgarán según el calendario de retención descrito en nuestra Política de Privacidad.

Podemos suspender o terminar tu cuenta si violas estos Términos, intentas comportamiento fraudulento o abusivo, o si la ley lo requiere. Proporcionaremos aviso anticipado razonable cuando sea factible.

15. Ley aplicable y resolución de disputas

Estos Términos se rigen por las leyes del Estado de Wyoming, Estados Unidos, sin tener en cuenta sus disposiciones de conflicto de leyes. Cualquier disputa se resolverá exclusivamente en los tribunales estatales o federales ubicados en el Condado de Sheridan, Wyoming, y consientes la jurisdicción personal de esos tribunales.

Lo anterior no priva a los consumidores de las protecciones obligatorias de la ley de su lugar de residencia donde tales protecciones no puedan ser derogadas por contrato (p. ej., protecciones al consumidor de la UE, disposiciones obligatorias del derecho del consumidor del Reino Unido o España).

16. Términos de Apple App Store (Reconocimiento del EULA Schedule 1)

Esta sección se aplica porque la App se distribuye a través de la Apple App Store y complementa el Acuerdo Estándar de Licencia de Aplicación de Apple para Usuario Final ("EULA de Apple"):

  • Partes: Estos Términos son un acuerdo únicamente entre tú y Five Castles LLC, no con Apple, Inc. Apple no es responsable de la App ni de su contenido.
  • Alcance de la licencia: La licencia que se te concede es limitada a una licencia intransferible para usar la App en cualquier producto de marca Apple que poseas o controles y según lo permitido por las Reglas de Uso en los Términos de Servicio de Apple App Store.
  • Mantenimiento y soporte: Five Castles es el único responsable de proporcionar servicios de mantenimiento y soporte para la App. Apple no tiene obligación de proporcionar mantenimiento o soporte.
  • Garantía: En caso de cualquier falla de la App para cumplir con cualquier garantía aplicable, puedes notificar a Apple, y Apple te reembolsará el precio de compra de la App. Hasta el máximo permitido por la ley, Apple no tiene otra obligación de garantía con respecto a la App.
  • Reclamos del producto: Five Castles, no Apple, es responsable de abordar cualquier reclamo relacionado con la App o tu posesión y/o uso de la App, incluyendo pero no limitado a reclamos de responsabilidad del producto, reclamos de que la App no cumple con cualquier requisito legal o regulatorio aplicable, y reclamos que surjan bajo la protección al consumidor o legislación similar.
  • Propiedad intelectual: En caso de un reclamo de un tercero de que la App o tu uso de la App infringe los derechos de propiedad intelectual de ese tercero, Five Castles será el único responsable de la investigación, defensa, resolución y descargo de cualquier reclamo de este tipo.
  • Cumplimiento legal: Declaras y garantizas que (i) no estás ubicado en un país sujeto a un embargo del Gobierno de EE.UU. o designado como país "que apoya el terrorismo"; y (ii) no estás listado en ninguna lista del Gobierno de EE.UU. de partes prohibidas o restringidas.
  • Beneficiario tercero: Reconoces y aceptas que Apple y sus subsidiarias son beneficiarios terceros de estos Términos y que, tras tu aceptación de estos Términos, Apple tendrá el derecho (y se considerará que ha aceptado el derecho) de hacer cumplir estos Términos contra ti como beneficiario tercero.

17. Disposiciones generales

Acuerdo completo: Estos Términos, junto con la Política de Privacidad y cualquier aviso en la App, constituyen el acuerdo completo entre tú y Five Castles sobre la App y reemplazan cualquier acuerdo previo sobre el mismo tema.

Separabilidad: Si alguna disposición de estos Términos se considera inaplicable, las disposiciones restantes permanecen en pleno vigor.

Sin renuncia: Nuestra falta de exigir alguna disposición no es una renuncia a nuestro derecho de hacerlo más tarde.

Cesión: No puedes ceder estos Términos; nosotros podemos cederlos a una entidad sucesora (p. ej., en una reestructuración corporativa o adquisición).

Fuerza mayor: No somos responsables por fallas causadas por eventos fuera de nuestro control razonable (desastres naturales, guerra, acción gubernamental, interrupciones de infraestructura).

Enmiendas: Podemos actualizar estos Términos. Los cambios materiales se comunicarán a través de la App o por correo electrónico al menos 30 días antes de que entren en vigor. El uso continuado de la App después de la fecha de entrada en vigor constituye aceptación.
